Depending on the nature of your product, your product may be required to clear and be released by agencies in addition to U.S. Customs and Border Protection. Below are forms for the FDA, FCC, and Fish and Wildlife. The forms must be completed and submitted with the commercial documents to obtain full release of the goods.
The Lacey Act is the United States' oldest wildlife protection statute. This Act combats trafficking in "illegal" wildlife, fish, or plants. The Food, Conservation, and Energy Act of 2008, amended the Lacey Act by expanding its protection to a broader range of plants and plant products; including the prevention of "illegal" logging practices.
 
The Lacey Act now makes it unlawful to import certain plants and plant products without an import declaration. The declaration must contain, among other things, the scientific name of the plant, value of the importation, quantity of the plant, and name of the country from where the plant was harvested. For paper and paperboard products containing recycled content, the declaration also must include the average percent of recycled content without regard for species or country of harvest. If any person submits the declaration and it contains false information, they may be prosecuted. Enforcement of the declaration requirement is being phased-in between April 1, 2009 through September 30, 2010.
 
  • For articles of "composite" wood, fiberboard, or particle board it is necessary to note the scientific name and country of harvest for each component of the "composite" wood, fiberboard, or particle board. If the manufacturer does not know the exact species used, they need to report each species that might have been used and the corresponding countries of harvest.
  • Shavings or 'left-over' materials are not recognized by the U.S. Dept. of Agriculture, Animal and Plant Health Inspection Service (APHIS) as recycled products. If shavings or 'left-overs' make up the imported product, the manufacturer needs to report each species that might have been used and the corresponding countries of harvest.
